Welcome to CalmWeatherWay ("we," "us," or "our"). These Terms & Conditions ("Terms") apply to your use of our yacht charter services including the website found at calmweatherway.rest (the "Service"), which is provided by CalmWeatherWay.
Engaging with our charter services or using our Service means you accept these Terms. Should you reject any portion of the terms, then the Service is not available to you.
2. Service Overview
At CalmWeatherWay, we offer high-end yacht charter services that span a variety of options such as:
- Day-to-day yacht hire
- Evening cruises
- Business getaways
- Private functions
- Prolonged charters
Our services are dependent on both availability and weather conditions. The ability to alter or cease services at any moment is reserved.
3. Booking and Reservations
3.1 Booking Process
For a charter reservation, you are expected to:
- Be 18 years or older
- Supply accurate and comprehensive data
- Make a deposit as delineated in your reservation confirmation
- Concur with these Terms & Conditions
3.2 Confirmation
Confirmation of your reservation is only valid once payment has been made and you have received our written confirmation. Service may be denied at our discretion.
3.3 Availability
Charter availability is contingent on the availability of vessels and favorable weather conditions. We will endeavor to honor your preferred dates and times as best as we can.
4. Payment Terms
4.1 Pricing
Pricing is quoted in € and incorporates all applicable taxes unless specified otherwise. Prices are susceptible to alterations without notice.
4.2 Payment Schedule
- Deposit: 50% of the overall charter expense is required at reservation time
- Balance: Due two days prior to the charter departure
- Supplementary charges (if any): Payable upon completion of the charter
4.3 Payment Methods
We accept the majority of credit cards, bank transfers, and certified cheques. We handle payment processing through secure and encrypted platforms.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours prior to departure: Total reimbursement less processing charges
- Between 24 and 72 hours prior to departure: 50% reimbursement
- Under 24 hours prior to departure: Non-refundable
5.2 Weather Cancellations
Should our captain determine weather conditions as unsafe, we offer the options to:
- Reschedule the charter to another available date with no additional fee
- Issue a full refund if rescheduling is not feasible
5.3 Mechanical Issues
If your assigned vessel experiences mechanical issues, we will strive to provide a comparable alternative. If an alternative is not available, a complete refund will be provided.
6. Safety and Conduct
6.1 Safety Requirements
All guests are required to:
- Heed all instructions from the crew
- Utilize any safety gear when necessary
- Disclose any medical issues that could impact their safety
- Stay within designated areas on the craft
6.2 Prohibited Items
The following articles are forbidden on board:
- Containers made of glass
- Illegal substances
- Weapons or firearms
- Excessive beverages (surpassing reasonable consumption)
- Pets (excluding those which have been pre-approved)
6.3 Conduct
Passengers should behave respectfully at all times. Charters may be ended prematurely without refund if passenger actions constitute a safety hazard or interrupt the experience of others.
7. Liability and Insurance
7.1 Our Liability
We limit our responsibility to the fee paid for your charter. We are not accountable for:
- Injuries sustained through passenger negligence
- Theft or damage to personal belongings
- Indirect, consequential, or exemplary harm
- Delays resulting from weather or events out of our control
7.2 Insurance Coverage
We maintain all-encompassing marine insurance for our vessels and operations. It is the responsibility of passengers to ensure their own travel and personal insurance.
7.3 Assumption of Risk
Taking part in our charter services signifies an acceptance that maritime activities come with inherent risks and you consent to being responsible for your safety and well-being.
8. Modifications and Itinerary Changes
We hold the right to alter itineraries, paths, or schedules for reasons such as weather, security concerns, or operational demands. We will put forth efforts to offer equivalent alternative experiences.
9. Force Majeure
We cannot be held responsible for hold-ups, cancellations, or changes caused by forces beyond our control, which include, but are not limited to:
- Dire weather conditions
- Natural phenomena
- Governmental constraints
- Port shutdowns
- Technical malfunctions
10. Privacy and Data Protection
Your private data is managed according to our Privacy Policy. Employing our services implies consent to the collection and use of your data, as set forth in our Privacy Policy.
11. Intellectual Property
